1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Punpun Police Station Case No. 187 of 2019, disclosing offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.
3. As per the FIR, on seeing the police party on the Punpun bridge dam, the driver of the Hero Majestic jumped into the water and fled leaving his vehicle. Upon search of the vehicle, a total quantity of 15 liters of country liquor has been recovered.
4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to dirty village politics. Petitioner has not been arrested from the
Patna High Court CR. MISC. No.82662 of 2024(2) dt.16-12-2024 2/2 spot and no illicit liquor has been recovered from the conscious possession of the petitioner. He next submits that petitioner has sold his vehicle i.e., Hero Majestic, which was seized from the spot, to another person prior to the occurrence.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that after five years, petitioner has come for anticipatory bail, he is the owner of the seized vehicle and no document as proof has been produced regarding sale of the seized vehicle, I am not inclined to grant the petitioner privilege of anticipatory bail.
