JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks regular bail in connection with Motipur P. S. Case No. 968 of 2018 registered for the offences punishable under Sections 272 & 273 of the Indian Penal Code and Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Recovery of 535.760 liters of liquor from one factory and name of the petitioner was also mentioned in the F.I.R. Apart from other, it appears that petitioner is accused in ten other cases of almost similar nature.

Submission of the learned counsel for the petitioner is that there is no recovery from his possession or from his house. He has been made accused only on suspicion. He is in custody for more than four months.

Patna High Court CR. MISC. No.76049 of 2019(3) dt.18-12-2019 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides, in view of the allegation and antecedents, I am not inclined to grant bail to the petitioner at this stage. However, if the trial is not concluded within a period of six months, petitioner is at liberty to renew his prayer for bail. With the above observations, this application is dismissed.
