2. The petitioner seeks regular bail in connection with Navinagar (Badem O.P.) P.S. Case No. 402 of 2023, lodged on 17.10.2023, under Sections 8/20(b)(ii)(B)/25 of the N.D.P.S. Act.
3. As per the prosecution, FIR has been lodged against the sole accused persons from whose house the recovery of total 1540 gms of Ganja has been recovered.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that antecedent of the petitioner is clean and he is in custody since 18.10.2023. He submits that the recovered amount is just above than the small quantity but much below the
Patna High Court CR. MISC. No.84394 of 2023(2) dt.10-01-2024 2/2 commercial quantity. Counsel further submits that charge sheet has already been filed. Upon the specific query that whether charge has been framed or not. Counsel submits that he is not aware that charge has been framed or not.
5. Learned counsel for the State opposes the prayer for bail.
6. In this background, I am not inclined to grant bail to the petitioner but liberty is granted to the petitioner that upon framing of the charges the petitioner shall move for bail and the trial Court is directed to release him on bail imposing conditions so that he may not evade appearance during trial.
