1. Heard learned counsel for the parties.
2. The petitioner in this application prays for bail apprehending his arrest in connection with Katoriya P.S. Case no.142 of 2024 registered for the offence punishable under sections 420 and 409 of the Indian Penal Code and section 7 of the E.C. Act.
3. As per the allegations in the FIR, the petitioner who happens to be a PDS shop dealer is said to be involved in black marketing of 96.4 quintals of wheat and 183 quintals of rice.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The allegations levelled are false and concocted. The petitioner has
Patna High Court CR. MISC. No.83986 of 2024(2) dt.16-12-2024 2/2 been proceeded against departmentally and his PDS dealership license has been suspended for which he has already moved this Court in CWJC no.8862 of 2024. He has no criminal antecedent.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR, the petitioner having moved this Court against the suspension of his PDS dealership and his not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Katoriya P.S. Case no.142 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Banka.
