2. Heard the learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks regular bail in connection with Special (NDPS) Case No. 49 of 2024, arising out of Kadamkuan P.S. Case no. 820 of 2023 registered for the offence under sections 8, 20(b)(ii) (a), 22(C) of the NDPS Act.

4. As per the prosecution case, 495 grams of ganja, 350 pieces of Pheniramne Maleate Injection IP Avil and 415 pieces of Buprenorphine Injection IP have been recovered.

5. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 27.11.2023.

6. Learned A.P.P. has vehemently opposed the prayer

7. Considering the period of custody, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned N.D.P.S. Act, Court No. 02, Patna/concerned Court below in connection with Special (NDPS) Case No. 49 of 2024 arising out of Kadamkuan P.S. Case no. 820 of 2023 subject to conditions that:- (i). The petitioner will mark his attendance at the Kadamkuan Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

(ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and noncooperation in the trial shall result in cancellation of the bail bond of the petitioner. (iii). Both the bailors should be close blood relatives of the petitioner.
