JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Laukariya P.S. Case No.19 of 2017 instituted for the offence under Sections 417, 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code pending in the Court of Chief Judicial Magistrate, Bettiah, West Champaran.

Counsel for the petitioner has submitted that he is not named in the First Information Report. His name has come during investigation on the basis of his photograph which is alleged to have been pasted on the sale deed.

Case diary has been received.

The learned APP after looking into the case diary has submitted that process under Sections 82 and 83 Cr. P.C. have

Patna High Court Cr.Misc. No.43584 of 2018 (3) dt.09-08-2018 2/2 been issued against the petitioner which has already been executed. The execution report is available in the case diary. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below in accordance with law without being prejudiced by this order.
