JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-01-2024 Heard Mr. Rajendra Narayan learned Sr. counsel, assisted by Mr. Ranjit Kumar, learned Advocate, for the petitioner learned A.P.P. for the State and learned counsel for the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 304, 304(A) of the Indian Penal Code.
3. Allegation against the petitioner is that he gave injection to the wife of the informant, after sometime his wife died due to injection.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against

It is further submitted that the petitioner has not provided any medicine or any injection to the informant and her wife, the informant himself provided the said medicine. It is next submitted that the deceased was seriously ill of Dengue fever and her platelets were very low at the time of treatment apart from that she was previously suffering from heart disease due to which she could not survive after attack of Dengue. On suspicion, petitioner has been implicated in the present case. He further submits that F.I.R. has lodged u/s 304 and 304A of the I.P.C. and not any chit or documents has shown by the informant that he purchased the said medicine or injections from the medical shop of the petitioner. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
5. Learned APP for the State opposed the prayer for bail.
6. Having regard to the facts and circumstances of the case, considering the facts that that F.I.R. lodged u/s 304 and 304A of the I.P.C. and not chit or documents has been served, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of
