JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Bihara P.S. Case No. 77 of 2018 for the offence under Sections 30(a), 38(i) and 41(i) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is a driver and he has not aware of the fact that in the Bolero pick-up van liquor was kept. Learned counsel submit that petitioner is in custody since 25.04.2018.
Considering the fact that the petitioner has remained in custody for more than two and half months and he has no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each
