ANJANA MISHRA ORAL ORDER 01-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.05.2018 in connection with Hasanpur P.S. Case No.1 of 2018 registered for the offence under Sections 147, 148, 149, 341, 323, 324, 325 and 307 of the Indian Penal Code.
Learned counsel for the petitioner submits that though there is allegation that the petitioner had attacked one Aklu Mahto with the butt of his pistol, the injury has been found to be having a lacerated wound on the forehead. It is further submitted that there has been partition suit pending between the parties. It is further submitted that on account of land dispute, the present occurrence took place. It is submitted
Patna High Court Cr.Misc. No.44088 of 2018 (3) dt.01-08-2018 2/2 that the petitioner shall abide by the terms and conditions of the order passed by this Court, if extended the privilege of bail.
Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Rosera, Samastipur, in connection with Hasanpur P.S. Case No.1 of 2018.
