JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-08-2018 The petitioner is seeking a direction for issuance of certificate of having passed Annual Secondary Examination2009, conducted by the Bihar School Examination Board. My attention has been drawn to Annexure-5 of the writ application, which according to the petitioner, is an application made to the Secretary, Bihar School Exmination Board for issuance of the said certificate.
Learned counsel for the petitioner states that the Board has refused to accept the application.
Learned counsel appearing on behalf of the Board, on
Patna High Court CWJC No.13733 of 2018(2) dt.24-08-2018 2/2 the other hand, has submitted that there is no question of the Board refusing to accept any application which the petitioner wanted to submit. He also submits that there is no explanation in the writ application as to why the petitioner has approached the Board for supply of the certificate after nine years having passed the examination.
In the facts and circumstances of the case, I dispose of this writ application with a liberty to the petitioner to approach the Grievance Redressal Cell of the Bihar School Examination Board, by making an application for issuance of the desired certificate. If such application is made within three weeks from today, the Court expects that the Board shall look into the grievance of the petitioner and take a final decision within maximum period of two months. The Court also expects that if the petitioner is found to have been successful in the said examination, the Board shall avoid taking technical plea in the matter of issuance of the certificate.
This application stands disposed of.
