The petitioner seeks bail in connection with Bairagania P.S. Case No.280 of 2018 registered under Sections 448, 307, 504, 506 and 386/34 of the Indian Penal Code besides Section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. as on the basis of the fardbeyan of the informant Umesh Prasad Gupta, the present case was lodged against two unknown. In course of investigation, the name of the petitioner surfaced in this case on the basis of the confessional statement of Shatrughan Kumar and, thereafter, the petitioner was apprehended in the present
Patna High Court CR. MISC. No.72818 of 2019(5) dt.05-03-2020 2/2 case and was remanded in this case on 09.04.2019. While the informant has claimed in the F.I.R. to identify the culprits on seeing them again but the petitioner was not put on T.I. Parade till date, while he is in custody sine 09.04.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, DistrictSitamarhi, in connection with Bairagania P.S. Case No.280 of 2018.
