2. The petitioner has prayed for bail in a case registered for the offence punishable under Section 305(a) of the B.N.S., 2023.
3. The case of the prosecution is that from the house of the informant, a laptop and mobile was stolen.
4. Learned counsel appearing on behalf of the petitioner has submitted that during course of investigation one Ritesh Raj was apprehended. Ritesh Raj has given his confessional statement. In his confessional statement he has admitted that he has stolen the articles and that this petitioner was waiting in the lane with the bike to facilitate him. Nothing
Patna High Court CR. MISC. No.84012 of 2024(3) dt.05-02-2025 2/2 has been recovered from the possession of this petitioner. He is having no criminal antecedent and from the CCTV footage also only the indulgence of Ritesh Raj is there in the occurrence. The petitioner is in custody since 09.09.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the above facts and circumstances, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Patna in connection with Buddha Colony P.S. Case No. 397 of 2024.
7. Accordingly, the present bail application stands allowed.
