2. The petitioners apprehend their arrest in connection with Rafiganj P.S. Case No. 98 of 2025, registered for the offences punishable under Sections 191(2), 191(3)m 190, 74, 118, 126(2), 115(2), 109(1), 303(2), 117(2), 351(2) of the BNS.

3. Allegedly, the petitioners along with one another co accused were indulge in eve teasing and misbehaving with the daughter of the brother-in-law of the informant. When the same was resisted, the petitioners along with 15 others barged into the house of the informant and started abusing and assaulting the accused persons and also dismantled the household articles and looted away the valuables.

Learned Advocate for the petitioners referring to the FIR contended that besides the fact that both the petitioners are men of tender age, there is omnibus nature of allegation against all the FIR named accused persons, 17 in numbers; some of the accused persons facing identical allegation have been allowed the privilege of anticipatory bail by the court below itself. So far the petitioners are concerned, they are having fair antecedent and they undertake that they will fully cooperate in the proceeding of the court. So far the injuries which are allegedly sustained to the informant and others are concerned, the same have been found to be simple in nature.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioners were involved in eve teasing and assaulting the informant and her family members.

Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the omnibus nature of allegation, coupled with the simple injuries to the injured, besides the fair antecedent of the petitioners and their tender age, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the

No.81619 of 2025(2) dt.10-12-2025 3/3 date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, Bihar in connection with Rafiganj P.S. Case No. 98 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
