Petitioner apprehends his arrest in Garkha P.S. Case No.274 of 2016 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Additional Chief Judicial Magistrate, 5th, Saran at Chapra.
Prayer of the petitioner for grant of anticipatory bail was earlier rejected by this Court by order dated 19.04.2017 passed in Cr. Misc. No.113 of 2017.
Counsel for the petitioner submits that petitioner is suffering epilepsy and he cannot move alone without assistance of some other person.
Since prayer of the petitioner for grant of
Patna High Court Cr.Misc. No.42607 of 2018 (2) dt.18-07-2018 2/2 anticipatory bail has already been rejected, this Court is not inclined to entertain this second anticipatory bail application. This application is, accordingly, dismissed.
The petitioner is directed to surrender in the Court below within a period of four weeks from the date of receipt of copy of this order with all relevant papers and, in the event, the Court below finds that the petitioner is suffering from epilepsy and unable to move independently, the Court below will consider the prayer of the petitioner in accordance with law, preferably on the same day, without being prejudiced by this order.
