Mr. Sri Prem Kumar Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 13-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Phenhara P.S.Case No. 17 of 2016 registered under Sections 363 and 366A of the Indian penal Code. Allegation in brief is that informant's daughter was married with one Santosh Mahto but after marriage she was kidnapped by the accused persons.

Submission is that all family members of the petitioner have been implicated in this case and allegation is not specific against the petitioner though specific allegation of committing rape to victim is against one Hari Mahto and other co-accused of this case namely Dhaneshwar Mahto has been granted to bail by the court below.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Mangal Mahto is directed to be released

Patna High Court Cr.Misc. No.42268 of 2018(2) dt.13-07-2018 2/2 on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-12, Motihari in connection with Phenhara P.S. Case No. 17 of 2016.
