The petitioner seeks bail in a case registered under Sections 147, 148, 149, 452, 341, 323, 354(A), 504, 506, 150, 379 & 427 of the Indian Penal Code and Section 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, in short, is that the accused person in drunken state tried to misbehave with the prosecution party.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 12-09-2019. Charge sheet/Prosecution report in this case has already been submitted.

Allegedly in drunken state, the petitioner is said to have misbehaved with the prosecution party. It is further submitted that the petitioner may be released on bail after completion of three months in custody. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of three months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 8204 of 2019 arising out of Patliputra P.S.
