1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Mahua P.S. Case no.358 of 2022 registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, the informant states that while he was returning on his motorcycle, three accused persons on the point of pistol looted the petitioner of his motorcycle, PAN card and other articles as given in detail in the FIR.

4. It is submitted by learned counsel for the petitioner that the FIR was registered against 2-3 unknown. The name of the petitioner transpired in course of investigation when allegedly some of the stolen articles were recovered from the

Patna High Court CR. MISC. No.83029 of 2023(2) dt.10-01-2024 2/2 possession of the petitioner. Learned counsel for the petitioner categorically denies any recovery of any incriminating article from the petitioner's possession. The petitioner is in custody since 22.7.2022 and chargesheet has been submitted in the case. It is lastly submitted that a number of coaccused have been enlarged on bail, orders of which have been annexed as Annexure-2 series.

Having heard learned counsel for the parties and taking into consideration the submissions made by learned counsel for the petitioner, the petitioner having remained in custody for more than 1 year 5 months since 22.7.2022 and grant of bail to the other similarly situated coaccused vide orders contained in Annexures-2 series, the Court directs the petitioner to be enlarged on bail in connection with Mahua P.S. Case no. 358 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
