This is an application for grant of anticipatory bail in connection with Bettiah Muffasil P.S. Case No. 498 of 2019 registered for the offence punishable under Sections 447, 341, 323, 324, 307, 354, 504, 506 and 34 of the Indian Penal Code. The allegation is regarding the accused persons including the petitioners herein having assaulted the informant and others resulting in injuries being inflicted upon them. The learned counsel for the petitioners has submitted that the grievous injuries, which have been inflicted upon the informant and others, is attributable to the co-accused person, namely,

Patna High Court CR. MISC. No.75011 of 2019(2) dt.27-11-2019 2/2 Israfil Devan and as far as the petitioners are concerned, there is a general and omnibus allegation, hence, they deserve the privilege of anticipatory bail. The petitioners are stated to be having a clean antecedent.

The learned counsel for the informant has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah West Champaran in connection with Bettiah Muffasil P.S. Case No. 498 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
