JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 414/34 of the IPC.
The name of the petitioner came in this case in the statement of Gulshan Kumar who along with two others were caught with stolen motorcycle. Admittedly, nothing has been recovered from the conscious possession of the petitioner and except aforesaid confessional statement of coaccused Gulshan Kumar, there appear to be nothing against the petitioner. Moreover, co-accused Gulshan Kumar has already been granted bail by a co-ordinate bench of this court.
Patna High Court Cr.Misc. No.43574 of 2018 (2) dt.20-07-2018 Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawadah in Nawadah Town P.S. Case no. 320/2018.
