The petitioner apprehends his arrest in Ratanpura P.S. Case No.5 of 2018 registered under Section 307 and other Sections of the Indian Penal Code.
The informant named the petitioner along with seven other accused persons and alleged that they having armed with different weapons came and began to abuse. The informant made allegation against Amit Kumar Jha that he assaulted with farsa and Ramesh Jha assaulted him with iron rod. Birendra Jha, Dhirendra Jha, Sunil Jha, Bipin Jha, Sumit Kumar Jha came there and also assaulted the informant. When the sister-in-law and mother of the informant came, the accused person namely Bipin Jha snatched ornaments and money.
Patna High Court Cr.Misc. No.42254 of 2018 (2) dt.19-07-2018 The learned counsel for the petitioner submits that there is a counter version. The injuries are simple in nature. There is no allegation of assault against the petitioner. Petitioner is of course alleged to have come with arms but the petitioner is not alleged to have assaulted anybody.
Considering the facts aforesaid and the fact that the petitioner is not alleged to have assaulted the informant, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Birpur, District-Supaul in connection with Ratanpura P.S. Case No.5 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
