2. The petitioner seeks regular bail in connection with Taraiya P.S. Case No. 16 of 2022 for the offence registered under Section 392 of the Indian Penal Code.

3. As per the prosecution case, on the date of occurrence three motorcycle borne miscreants intercepted the informant and on the gun point demanded the money withdrew by him. In fear, informant gave them Rs. 60,000/-. In the meantime, accused persons fled away.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the F.I.R. and no T.I.P. has been conducted in this case. There is no recovery from the petitioner.

Patna High Court CR. MISC. No.83554 of 2023(2) dt.18-01-2024 2/2 Petitioner has one criminal antecedent in which anticipatory bail has been granted by the learned Court below. He is in custody since 23.08.2023. It is further submitted that name of the petitioner has been implicated in the confessional statement of co-accused Rambabu Rai, who has already been granted bail by the learned Court below vide B.P. No. 1827 of 2022. Chargesheet has already been submitted in this case. There is no chance of absconding of the petitioner or tampering with the evidence.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Taraiya P.S.
