JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2020 The petitioner who is in custody since 16.07.2019 seeks bail in connection with Khaira P.S. Case No. 194 of 2019, dated 15.07.2019, instituted for the offences under Sections 341, 323, 307, 447, 448 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation in the F.I.R. is that the informant was fired upon by one Shiv Yadav and the petitioner. There is but only one injury on the person of the victim/informant which is stated to be simple in nature.

The learned counsel for the petitioner has

Patna High Court CR. MISC. No.72815 of 2019(3) dt.05-03-2020 2/2 drawn the attention of this Court to the averments made in the F.I.R. which indicate that there was dispute between the parties with respect to contract work. The petitioner has clean antecedents.

Considering the aforestated facts and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of C.J.M. Jamui in connection with Khaira P.S. Case No. 194 of 2019.

The application stands allowed.
