Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.

As per F.I.R. informant has alleged that on 16.12.2012 at about 2:00 A.M., 8-10 unknown miscreants committed dacoity in his house and looted away cash, mobile phones and other household articles.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. Petitioner is not named in the F.I.R. He has been falsely implicated in this case due to village rivalry. Similarly placed co-accused has

Patna High Court CR. MISC. No.87336 of 2019(3) dt.20-01-2020 2/2 been granted bail by co-ordinate bench of this court vide order dated 18.12.2019 passed in Cr. Misc. No. 80335 of 2019. Petitioner is in custody since 20.07.2019 having no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Katoriya (Jaipur) P.S. Case No. 232 of 2012, subject to conditions:

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
