2. The petitioner seeks regular bail in Patahi P.S. Case No. 236 of 2025, dated 18-05-2025, registered under Sections 316(2), 318(4), 61(2), 338, 336(3) and 3(5) of the Bharatiya Nyaya Sanhita 2023.

The allegation in the FIR is that accused persons namely, Gaurav Prakash @ Jheetu Singh, Ujjwal Kumar Singh @ Bittu Singh, Lalbabu Singh, Sushil Singh and Sunil Kumar entered into a criminal conspiracy to illegally dispossess the informant from his ancestral land.In furtherance of this conspiracy, they allegedly prepared false documents and executed fraudulent sale deeds,including a sale deed dated 23.09.2024

Patna High Court CR. MISC. No.79172 of 2025(2) dt.19-11-2025 2/3 through which the land was transferred to the petitioner. The informant also alleges that parts of the same land had earlier been sold in the year 2022 through similar fraudulent acts.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is a bona fide purchaser of the land for valuable consideration. The sale deed in favour of the petitioner was executed by Gaurav Prakash @ Jheetu Singh, Ujjwal Kumar Singh @ Bittu Singh, Lalbabu Singh, Sushil Singh and Sunil Kumar after receiving the consideration amount. It is further submitted that the allegations, at best, give rise to a civil dispute, and the petitioner has no involvement in any criminal act. The question of title, as claimed by the informant, can only be adjudicated by a competent Civil Court. Lastly, it is submitted that the petitioner has no criminal antecedents and has been in custody since 22.07.2025.

5. Learned Additional Public Prosecutor for the State has opposed the prayer.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of

Patna High Court CR. MISC. No.79172 of 2025(2) dt.19-11-2025 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran at Motihari, in connection with Patahi P.S. Case No. 236 of 2025.

7. The application stands allowed.
