The petitioner in the present case is seeking regular bail in connection with Muffasil P.S. Case No. 89/2019 registered under Sections 394 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Begusarai.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case, his name has transpired in the confessional statement of the co-accused. Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.79951 of 2019(3) dt.16-12-2019 2/2 although it is submitted on behalf of the petitioner that his name has transpired in the confessional statement of the co-accused and no incriminating material has been recovered from his possession, looking into the criminal antecedent of the petitioner having at least five cases on his head of similar nature and the custody being hardly six months at this stage, this court is not inclined to grant regular bail to the petitioner. Prayer for regular bail of the petitioner is refused. The petitioner may renew his prayer for bail after a reasonable time.
