2. The petitioner has prayed for bail in connection with Baheri P.S. Case No.83 of 2024 registered for the offence punishable under Section 394 of the Indian Penal Code.
3. The case of the prosecution is that the informant was going on splender bike of his master, four persons on two bikes stopped him, assaulted him and on the gun point, snatched Rs.3,000/-, mobile and the bike. The case was lodged against unknown miscreants. The name of this petitioner has surfaced in the confessional statement of one Fulbababu Kumar.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has
Patna High Court CR. MISC. No.82955 of 2024(3) dt.28-02-2025 2/2 committed no offence. He has been falsely implicated in this case. Nothing has been recovered from his possession. It has also been submitted that Fulbabu Kumar has been granted bail by this Court vide order dated 23.01.2025 in Cr. Misc. No. 76538 of 2024 and the case of this petitioner stands on similar footing. Moreover, petitioner is languishing in judicial custody since 05.09.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Darbhanga in connection with Baheri P.S. Case No. 83 of 2024.
