2. The instant application for anticipatory bail have been filed by the petitioner apprehending his arrest in connection with Narpatganj P.S. Case No. 762 of 2023 registered for the offence under Sections 392 of the Indian Penal Code.
3. The case of the prosecution is that the informant is Assistant Manager of I.C.I Bank, Araria. On the date of occurrence, he was going to village Mirdaul on his bike and he was carrying a bag which contain cash and certain documents. It is alleged that three persons on a bike surrounded him and on gun point, snatched his bag and his mobile. The bag contained ATM card, Pan Card Adhar Card and other documents and Rs.

4. Learned counsel for the petitioner submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that the FIR was lodged against unknown miscreants. During the course of investigation, one Vikash Kumar was apprehended and he has given his confessional statement. The name of this petitioner surfaced in the confessional statement of co-accused Vikash Kumar. It is submitted by the learned counsel for the petitioner that noting has been recovered from the possession of this petitioner and that the petitioner is having clean criminal Antecedent.
5. In contra, learned APP appearing for the State and learned counsel for the informant have opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Narpatganj P.S. Case No. 762 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/-
Patna High Court CR. MISC. No.82751 of 2024(2) dt.10-12-2024 3/3 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Araria subject to the conditions as laid down under section 438(2) of the Cr.P.C.
