2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, 450 liters of country made liquor is said to have been recovered from the place of occurrence.
4. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. No incriminating article has been recovered from his conscious physical possession. Earlier anticipatory bail application was filed by the petitioner but during the pendency of the
Patna High Court CR. MISC. No.84623 of 2024(2) dt.20-12-2024 2/2 application, the petitioner was arrested, therefore, the same was withdrawn. The petitioner has one criminal antecedent and has been languishing in custody since 22.10.2024.
5. Petitioner is agreed to deposit a sum of Rs.5,000.00 (Rupees Five Thousand) in the account of Lawyers' Association Welfare Benevolent Fund, bearing Account No.: 7801893276, IFSC Code : IDIB000L501, Bank Name: Indian Bank, BranchLNMI, Bailey Road, Patna.
6. Learned APP for the State opposed the bail petition.
7. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Bhagwan Bazar P.S. Case No. 348 of 2024.
8. The bail bond of the petitioner shall be accepted by the learned Court below on showing receipt of deposit of the aforesaid amount in the account of Lawyers' Association Welfare Benevolent Fund.
