Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420/120B/34 and other allied sections of the Indian Penal Code as well as under the Bihar Prohibition & Excise Act, 2016.

It is alleged that a large quantity of foreign liquor as well as liquor manufacturing materials were recovered from the Bathan of the petitioner.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is no way concerned with the said recovery. Section 100 Cr.P.C has not been followed during search and seizure.

Considering the magnitude of recovery of foreign liquor and the liquor manufacturing materials from the bathan of the petitioner, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail within six weeks which would be disposed of on its own merit without prejudice.
