2. The petitioner apprehends his arrest in Mahila P.S. Case No. 70 of 2022 registered for the offence punishable under Sections 341, 323, 498(A), 504 and 506/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

3. Allegedly, the informant's husband was having illicit relation with his Bhabhi. On protest, the informant's husband and in-laws started to assault her and demanded Rs. Two lakhs as dowry. On refusal, she was assaulted and was threatened of dire consequences.

4. Learned counsel for the petitioner has submitted that the petitioner is brother-in-law (Bhainsur) of the informant.

Patna High Court CR. MISC. No.83683 of 2023(2) dt.18-01-2024 2/2 He has no concern with day-to-day affairs of the couple. The FIR itself shows that he was residing at Delhi at the time of occurrence.

5. Learned Additional Public Prosecutor opposed the prayer for anticipatory bail.

6. Considering the above-mentioned facts and circumstances of the case, let the petitioner named above, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Lakhisarai in connection with Mahila P.S. Case No. 70 of 2022 subject to the conditions as laid down under Section 438 of the Cr.P.C.

7. The petitioner is directed to appear in the court below on each and every date fixed by the trial court and if, he makes himself unavailable on two consecutive dates, his bail bond shall be liable to be cancelled.
