The petitioner is languishing in custody for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.

The petitioner is husband of the victim of dowry death. Petitioner is in custody since 21.06.2017. Earlier this Court had refused the prayer on 20.03.2018, vide Annexure-1, with liberty to renew the prayer after framing of the charges. The report of the learned trial Judge would reveal that charges have already been framed and prosecution evidence is going on.

Considering the period already undergone, let

Patna High Court Cr.Misc. No.53879 of 2018(3) dt.12-12-2018 2/2 the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Sessions Trial No.559 of 2017, arising out of Saraiya P.S. Case No.195 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
