Petitioner apprehends his arrest in connection with Arer P.S. Case No.169 of 2018 for the offence punishable under Sections 147, 149, 341, 323, 324, 307, 354B, 427, 379, 504, 506 of the IPC.
Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. In fact altogether forty persons have been named in the FIR, but no specific allegation attributed against the petitioner. Moreover, this petitioner has implicated in this case in retaliation of earlier case bearing Arer P.S. Case No.168/2018, which is evident from Annexure-2 to this petition. The petitioner
Patna High Court CR. MISC. No.74219 of 2019(3) dt.04-02-2020 2/2 has also sustained injury inflicted by the informant side which is evident from Annexure-4 to this petition. Further it is submitted that the parties have compromised their case by way of compromise petition, which is evident from Annexure-5 to this petition Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on anticipatory bail in the event of his arrest or surrender in the Court below within a period of four weeks in connection with Arer P.S. Case No.169 of 2018 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Munsif cum J.M., Ist Class, Benipatti, Madhubani subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
