The petitioner who is in custody since 18.6.2019 has filed the instant application for grant of bail in connection with Begusarai Town P.S. Case No. 243 of 2019 (District- Begusarai) registered for the offence punishable under section 394 of the Indian Penal Code.
As per the allegation in the FIR, the vehicle of informant who after collecting cash from different places proceeded for the Bank, was looted.
It is submitted by learned counsel for the petitioner that the name of the petitioner has transpired in course of investigation on the confessional statement of one Jay Prakash Thakur made before the police. He is in custody since 18.6.2019
Patna High Court CR. MISC. No.73087 of 2019(3) dt.10-12-2019 2/2 and has not been put on T.I.Parade. It is further submitted that no incriminating article has been recovered from the possession of the petitioner. It is further submitted that one case mentioned in paragraph 3 of the petition against him, his name has transpired also on the confessional statement of the said Jai Prakash Thakur after lodging of this case.
The application for bail was opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including no recovery of any incriminating article and the petitioner not being put on T.I.Parade, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai P.S. Case No. 243 of 2019 (District- Begusarai).
