JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-07-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code and converted under section 392 of the Indian Penal Code. Petitioner is not named in the first information report and the written report of informant goes to show that the written report has been signed by one Ganesh Bhagat whereas the aforesaid written report appears to have been written by Sunil Bhagat. Moreover, the prosecution claims that Alto Car which has been used in the commission of offence was recovered in front of the house of the petitioner.

No.43636 of 2018 (2) dt.20-07-2018 2/2 recovered as yet and in the aforesaid circumstance, except the above stated material, there appears to be nothing against the petitioner, who does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st ( West) Muzaffarpur in connection with Saraiya ( Jaitpur O.P.) P.S. Case No. 126 of 2018.
