2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 143 (I), 145, 98, 3 (5) of the BNS, 2023.

3. The case of the prosecution is that the house of the petitioner was raided and from his house six girls of tender age of about 16-17 years were recovered. The case was registered under Immoral Trafficking (Prevention) Act and bonded Labour System Act.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that during the course of investigation, the recovered girls have given their statement under Section 183 of the BNS in which

They were not brought on this profession forcibly, They were never forced to work in the 'orchestra'. Moreover, the petitioner is languishing in judicial custody since 11.10.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barhariya P.S. Case No. 490 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VI cum Special Judge, POCSO, Siwan.
