The petitioner is in custody since 07.05.2018 in connection with Buxar (T) P.S. Case No. 227 of 2018 for the offence registered under Sections 341, 323, 376, 511 and 342 of the Indian Penal Code.

Learned counsel for the petitioner submits that only because the petitioner had gone to persuade his wife to come back to her matrimonial home and there was dispute between the two families, the sister-in-law has made the allegation against the petitioner. However, there has been no medical examination of the girl nor has she been made any statement under section 164 Cr.P.C. He further submits that the entire allegation is false and mischievous and he has been languishing in jail since 07.05.2018.

No.43850 of 2018 (2) dt.01-08-2018 Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S.
