2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 ( 2 ), 191 (3) , 190, 118 ( 2 ), 109 (1) , 352 and 351 ( 2 ) of BNS. 3 . As per F.I.R., informant alleged that petitioner No. 1 is order giver and petitioner No. 2 is said to have assaulted informant by iron rod.
4. It is submitted on behalf of the petitioners that there is no allegation of assault against this petitioner No. 1 and though, petitioner No. 2 is alleged to have assaulted informant but there is no injury report on record to substantiate the
Patna High Court CR. MISC. No.79673 of 2025(2) dt.19-11-2025 2/2 allegation of assault against him. Petitioners have falsely been implicated in this case due to land dispute . Petitioners claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the aforesaid facts, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM East Champaran at Motihari in connection with Lakhaura P.S. Case No. 98 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
