The petitioner, who is in custody, seeks bail in connection with Parbatta P.S. Case No. 127 of 2018 registered for the offences punishable under Sections 25(1-B) (a) 26 of the Arms Act.

Allegation against petitioner is of recovery of one country made pistol and 19 cartridges from the possession of the petitioner.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to instance of his enemies. There is no material in the case diary against him. Petitioner has no criminal antecedent and he is in custody since 10.04.2018.

Patna High Court Cr.Misc. No.44328 of 2018(3) dt.27-09-2018 2/2 Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Parbatta P.S. Case No. 127 of 2018.
