2. In the present case, the petitioner seeks bail in connection with Lalmaniya P.S. Case No. 29 of 2025, registered for the alleged offence under Sections 126(2), 115(2), 118(1), 109, 74, 303(2), 352, 3 (5) of BNS, 2023.
3. As per prosecution case, the petitioner and other coaccused persons abused and assaulted the informant during the panchayati. When the family members of the informant intervened to rescue him, they were also assaulted by the petitioner and other co-accused persons causing a number of injuries to them.
4. The learned counsel for the petitioner submits that

There is case and counter case and the wife of the petitioner has filed Lalmaniya P.S. Case No. 28 of 2025 against the informant and others and this case is prior to lodging of the present case by the informant. The learned counsel further submits that specific allegation against the petitioner is of causing injury on the head of the uncle of the informant by means of a rod, but the injury report shows stitched wound having dimension of 3 cm long on left temporal area of Jugti Yadav and it was found to be simple in nature. The learned counsel further submits that the injury reports do not corroborate the allegation made in the FIR. There is land dispute between the parties, who are agnates and for this reason, the present case has been lodged. The petitioner is having criminal antecedent of three cases and he is in custody since 06.09.2025.
5. Learned APP vehemently opposes the submission made on behalf the petitioner.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the case and counter case of the parties and further considering the simple nature of injuries attributed to the petitioner and also considering the period of custody of the petitioner, he is

No.80915 of 2025(2) dt.03-12-2025 3/3 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jhanjhapur, Madhubani/court concerned, in connection with Lalmaniya P.S. Case No. 29 of 2025, subject to the conditions mentioned in Section 480 (3) of BNSS and also the following conditions :
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
