Petitioner, already in custody, seeks bail in connection with Sonepur P.S. Case No.103 of 2018 registered under Section 395 of the Indian Penal Code.
FIR is against unknown. The allegation is of committing dacoity.
A pick up van along with paint loaded in the vehicle, Rs.2500/- and one mobile were looted from the informant. Learned counsel for the petitioner submits that none of the incriminating material was recovered from possession of the petitioner rather looted mobile was recovered from possession of another co-accused Bittu Kumar and the so called recovery of one mobile and Rs.30,000/- are his personal belongings and
Patna High Court Cr.Misc. No.44056 of 2018(2) dt.20-07-2018 2/2 except the confessional statement of the petitioner, there is no other material against him, moreover he was also not put on TIP and investigation has been completed.
Having considered the aforesaid facts and circumstances, petitioner Uttam Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 1st, Saran at Chapra in connection with Sonepur P.S. Case No.103 of 2018.
