Petitioner is apprehending his arrest in connection with Barbigha P.S. Case No. 34 of 2017 for the offences registered under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.
Informant who is petitioner in this case has stated in his written complaint that on 05.02.2017 at about 09:30 A.M. his father was digging the earth on his land for construction of house. In the meantime, Bilayati Singh and Dinesh Singh armed with pistol arrived there and Dinesh Singh caught hold his father and Bilayati Singh @ Ram Bachan Sharma fired from his pistol which hit the chest of his father and died.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.45755 of 2018(3) dt.10-09-2018 2/2 he is also informant of the present case and in collusion with the F.I.R. named accused persons, the police has made him accused. He is innocent and has been falsely implicated in this case. Petitioner has no criminal antecedent. In the facts and circumstances as stated above, in the present case, petitioner above named, in the event of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S. Case No. 34 of 2017 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
