The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 149, 341, 342, 323, 324, 325, 307, 504 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case merely because the informant has tried to outrage the modesty of the daughter of the petitioner intruding into his house and regarding the same occurrence the wife of the petitioner has lodged the case against the informant. The petitioner is said to have fractured the leg of the informant by assaulting by means of rod but the doctor has found abrasion injury on the leg of the informant and without any x-ray report etc. the doctor has opined nature of injury as grievous. Other co-accused persons have been enlarged on bail by a co-ordinate bench of this court vide order dated 18.12.2018 passed in Cr. Misc. No. 74427 of 2018. The petitioner has no criminal antecedent and has been languishing in custody since 11.09.2019.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail
