2. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 329(3), 126(2), 115(2), 109, 118(1), 352, 351(2) and 3(5) of B.N.S., 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 02.06.2025 at 06:00 a.m., five named accused persons including the petitioner came and assaulted by Kudal causing injury on head. Further, the petitioner also assaulted by Kudal on head and the accused persons thereafter assaulted his son Abhishek Kumar and the occurrence took place on account of dispute relating to land.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the
Patna High Court CR. MISC. No.79790 of 2025(2) dt.08-12-2025 2/2 informant. It is next submitted that in the first part of the allegation, it is alleged that all the accused assaulted him by Kudal causing injury on head and thereafter it is alleged that even petitioner assaulted by Kudal. It is next submitted that on account of dispute relating to land, an altercation took place in which both sides assaulted each other. It is also submitted that petitioner is not a criminal.
5. Learned APP opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, let petitioner, above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Pakaridayal P.S. Case No.254 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. (Satyavrat Verma, J) Sanjay/- U T
