2. The petitioners have preferred this application for grant of regular bail in connection with S.T. Case No. 196/2024 arising out of Saur Bazar P.S. Case No. 510 of 2018 dated 06.09.2018 registered for the offences punishable u/ss 302, 201 read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, on 04.09.2018 at 2.00 O'clock in the night, the petitioners and the co-accused persons are alleged to have lifted the father of the informant in sleeping position. Patna High Court CR. MISC. No.632 of 2025(2) dt.02-04-2025 2/3 Manju Sada went for grass cutting and grassing animals. They saw and made noise. After information, he went there and saw the dead body of his father and informed the police officials.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The occurrence took place on 04.09.2018 but the F.I.R. was lodged on 06.09.2018 and there is no explanation for this delay. There is no specific allegation against the petitioners. The petitioners have no concern with the alleged offence. Nothing has been recovered from the conscious possession of the petitioners. The co-accused person has already been granted bail by the Coordinate Bench of this court vide order dated 30.04.2019 passed in Cr. Misc. No. 10224/2019. The petitioners have one criminal antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 15.04.2024.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.632 of 2025(2) dt.02-04-2025 3/3 learned Court concerned, Saharsa in connection with S.T. Case No. 196/2024 arising out of Saur Bazar P.S. Case No. 510 of 2018 with the condition :- (i) The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
