2. The petitioner apprehends his arrest in a case registered for the offence under Sections 96, 137(2) of the Bhartiya Nyaya Sanhita, 2023.
3. It is alleged that this petitioner kidnapped the minor daughter of the informant for the purpose of marriage.
4. Learned counsel for the petitioner submits that during course of investigation, the victim girl was recovered and in her statement recorded under Section 183 of B.N.S.S., 2023, she has categorically stated that she on her own accord left the house and solemnized marriage with petitioner at Balia. She disclosed her age as 20 years, whereas learned Court below has assessed her age as 18 years. Petitioner claims clean

5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the statement of victim recorded under Section 183 B.N.S.S., 2023 and clean antecedent of petitioner, the prayer for anticipatory bail is allowed. Let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge - 6th cum Special Court, POCSO, Bhojpur at Ara in connection with Ara Town P.S. Case No. 451 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
