Petitioner seeks bail in Khagaul P.S.Case No.86 of 2018 registered for the offences under Sections 302/34 of the I.P.C. and Section 27 of the Arms Act.
Allegation against the petitioner is of firing on the deceased along with co-accused Arvind Paswan. Submission of the learned counsel for the petitioner is that the informant who happens to be the wife of the deceased in her statement has not named this petitioner as assailant of her husband rather she has named Arvind Paswan. He is in custody since 7.5.2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be
Patna High Court Cr.Misc. No.45692 of 2018 (3) dt.11-09-2018 2/2 released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.-5th, Danapur, Patna, in Khagaul P.S. Case No.86 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trail and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
