2. Petitioners seek regular bail in connection with Kaimur (Bhabhua) Excise P.S. Case No. 831/2024 dated 27.10.2024 registered for the offences punishable under Sections 30(a), 32(1), 32(3), 41(1) and 41(2) of the Bihar Prohibition and Excise Act.

3. The main submissions advanced by learned counsel for the petitioners are that the instant matter relates to the recovery of 77.760 litres of foreign liquor and the petitioners have been falsely roped in the present matter, in fact they were not present in the alleged vehicle and they had to attend family

No.83078 of 2024(2) dt.04-12-2024 2/2 function and by the side of canal after attending the call of nature, they were returning back and in the meantime, the police party made them accused on suspicion. It is further submitted that the petitioners are neither the owner nor the driver of the alleged vehicle and they have been languishing in jail since 27.10.2024, having fair and clean antecedent and against them, the investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioners.

Considering the above submissions and mainly the petitioners' fair and clean antecedent, their custody period and completion of the investigation against them, this Court is inclined to grant the relief of regular bail to the petitioners. Accordingly, let the petitioners named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Kaimur (Bhabhua) Excise P.S. Case No. 831/2024.
