The petitioner apprehends his arrest in Deepnagar P.S. Case No. 236 of 2019, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 353, 337, 338, 224 and 225 of the Indian Penal Code and section 27 of the Arms Act.
The informant alleged that on 21.08.2019 at about 20.15 pm, when he along with other police officials went to village Tungi for arresting Ajay Singh, accused of Deepnagar P.S. Case No. 167 of 2019 and he was caught with the help of police personnel, but accused Ajay Singh, called his family members and other people who attacked upon the police party by means of brick-stone, lathi, spear due to which informant sustained severe injury and they got released the accused Ajay
Patna High Court CR. MISC. No.75212 of 2019(2) dt.06-03-2020 2/2 Singh, who went inside the house and brought a country made pistol and fired upon the informant with intention to kill him, but anyhow he saved himself. The other police personnel sustained injuries. The local chowkidar disclosed the name of accused persons including this petitioner.
It is submitted that petitioner has falsely been implicated in this case. Local chowkidar disclosed the name of this petitioner. There is general and omnibus allegation against this petitioner. Injuries sustained by the informant is simple in nature. Petitioner has got clean antecedent.
Considering the facts aforesaid, the petitioner above-named in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deepnagar P.S. Case No. 236 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure (Prabhat Kumar Singh, J) vinita/- U T
