For the Petitioner/s :

Mr.Binod Kumar Mishra For the Opposite Party/s :

Mr.Madhuri Lata ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2020 Earlier prayer for anticipatory bail of the petitioners was rejected by this Court by order dated 29.8.2029 passed in Cr.Misc.No. 38214 of 2019 on merit.

Submission of learned counsel for the petitioners is that some facts could not be placed before this Court and as such their prayer for anticipatory bail was rejected though prayer for anticipatory bail of some other co-accused persons was allowed by a co-ordinate Bench of this Court by order dated 18.10.2019 passed in Cr.Misc.No. 63907 of 2019. Heard learned APP also.

Patna High Court CR. MISC. No.76543 of 2019(2) dt.29-01-2020 2/2 It appears from perusal of the record that considering the merit of the case prayer for anticipatory bail of the petitioners was rejected and, as such I am not inclined to interfere with the earlier order. However, if petitioners surrender and pray for regular bail, the same shall be considered on its own merit, without being prejudiced by the order of this Court. Accordingly, this application is dismissed.
