2. The petitioner apprehends his arrest in connection with Complaint Case No. 9092 of 2023 registered for the offence under Section 406 of the Indian Penal Code and under Section 138 of the N.I. Act.

3. As per the prosecution case, the petitioner and the complainant were business partners and the petitioner is said to have cheated the complainant.

4. It has been submitted by the learned senior counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the petitioners were business partners in an agency of TVS

Patna High Court CR. MISC. No.79927 of 2025(6) dt.25-06-2026 2/2 company and there is case and counter case for bouncing of cheques from both the parties. He next submits that the petitioner has also filed a civil suit which is still pending and in the same, the other side has also appeared.

5. From the reading of the complaint and the materials available on record, the present appears to be a business dispute between the parties and the same is given colour of criminality.

6. In view of the above, this application is allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Complaint Case No. 9092 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.

8. As a condition of this order, the petitioner is directed to co-operate in the trial.
